Tim Powell is a leading UK patent litigator with extensive experience in complex, multijurisdictional IP disputes. He represents clients before the English High Court, Court of Appeal and Supreme Court and has significant experience in electronics and telecommunications disputes, including the enforcement of standard-essential patents and FRAND licensing. A former co-founder of a specialist IP firm and ranked Band 1 for UK patent litigation by Chambers.

Le Chen leads IP policy in Europe and dispute resolution at Xiaomi, bringing an in-house perspective to some of the most important questions in SEP licensing and FRAND. Previously, he was Senior IP Counsel at ABB, where his work included patent licensing, IP benchmarking, digital innovation and standardisation. Earlier in his career, he worked at a German IP law firm and was involved in Huawei v ZTE, which became a landmark CJEU decision on SEPs and FRAND.
What the discussion is about
How do you put a price on access to thousands of patents, owned by dozens of companies, across multiple jurisdictions?
The UK Supreme Court’s decision in Tesla v InterDigital raises that question in a striking new context. For patent lawyers, licensing professionals and valuation specialists, the implications go well beyond the immediate dispute. Tesla brings into focus some of the hardest questions in patent valuation: what makes a global portfolio valuable; how comparable licences and market evidence should be used; how the value of individual portfolios is aggregated; and whether the efficiencies of a licensing platform form part of the economic value of the licence itself.
Tim Powell of Morgan Lewis and Le Chen of Xiaomi will explore what Tesla may tell us about the developing methodology for valuing global patent rights – and what happens when courts are asked to put a number on a licensing market of enormous scale.
