Victor Diz Torres is a Brazilian judge serving at the 7th Business Court of the Tribunal de Justiça do Estado do Rio de Janeiro. He earned his law degree from the Universidade do Estado do Rio de Janeiro (UERJ) and clerked for Justices Custódio de Barros Tostes and Luiz Fernando de Andrade Pinto at the Rio de Janeiro Court of Appeals.

His judicial work focuses on complex business disputes, particularly patent litigation, industrial property, competition, technology, and standard-essential patents (SEPs). Alongside his judicial role, he teaches at the Escola de Administração Judiciária and Fundação Getulio Vargas (FGV), contributing to judicial training and public competitive examinations.

What the discussion is about

This talk will examine the role of injunctions in Brazilian patent litigation, with a particular focus on when Brazilian courts grant injunctive relief, how such orders are enforced in practice, and how courts balance exclusivity, market access, and proportionality in innovation-driven disputes.

The presentation will also address the emerging treatment of the FRAND defence in Brazil, especially in cases involving standard-essential patents. It will explore how Brazilian courts are approaching questions of licensing conduct, good faith negotiation, competition concerns, and the limits of injunctive relief where FRAND commitments are raised.
